The Regulatory Parameter That Determines Market Access — Ink Chemistry, Not Print Method #

When brand buyers think about compliance for screen or pad printed packaging, they usually focus on the print process. The right question is about ink formulation.

Print method is almost irrelevant from a regulatory standpoint. A UV-cured screen ink and a solvent-based pad ink can both be fully compliant or both create serious market access problems depending on what’s in the formulation. The variables that regulators and customs authorities actually test for are photoinitiator migration (UV systems), residual solvents (solvent-based systems), and heavy metal content in pigments across both.

For food-adjacent packaging — meaning the printed surface is not in direct food contact but the article is reasonably likely to be stored with food — EU Regulation 10/2011 on plastic materials does not apply directly to inks, but Swiss Ordinance SR 817.023.21 (Annex 6) does impose migration limits on printed layers. We treat SR 817.023.21 compliance as our baseline for any client shipping into the EU food-adjacent category, because Swiss law currently sets the most specific compositional restrictions on printing inks in the region.

For toy packaging, the applicable standard is EN 71-3:2019+A1:2021 (Migration of certain elements). Chromium, barium, selenium, and lead limits under Category III migration testing are the ones most commonly triggered by legacy pigment formulations. Our internal form QC-F14 flags any ink batch with pigment lots sourced outside our approved vendor list (AVL) for mandatory XRF screening before the job runs.

REACH SVHCs are the second major trigger. Under Article 59 of REACH (EC) No 1907/2006, substances of very high concern above 0.1% w/w in any article must be communicated down the supply chain. Aromatic hydrocarbons used as screen ink diluents — particularly naphthalene-based and benzene-derivative solvents — have appeared on the SVHC candidate list since 2008 and still show up in ink formulations from suppliers who haven’t reformulated.

FDA 21 CFR §175.300 and §175.105 govern indirect food contact materials in the US market. Screen and pad inks on the outer surface of food packaging are technically outside direct food contact scope, but many US retailers (notably Walmart and Target) contractually require indirect food contact compliance as a condition of vendor approval. We see this in about half of the US retail brand briefs we receive.

What to Request from Your Ink Supplier — and What the Response Tells You #

Ask your ink supplier for a full Safety Data Sheet (SDS) under GHS/UN Recommendations Rev.9, plus a separate Declaration of Compliance (DoC) that references the specific markets you’re shipping to. An SDS alone is insufficient for market compliance documentation — it tells you about workplace handling hazards, not consumer product safety thresholds.

The DoC should state, by name: REACH compliance status, EN 71-3 category (if toy-adjacent), and any Swiss SR 817.023.21 claim. If a supplier sends you a generic “our products comply with relevant regulations” letter, that is not a DoC. Reject it and ask for the specific regulation citations and the test data behind them.

Ask specifically for photoinitiator migration test results if you are using UV-cured screen inks. The photoinitiators ITX (isopropyl thioxanthone) and benzophenone both have documented migration histories and have been the subject of EFSA opinions. ITX migration above 0.002 mg/kg into food simulant (EU migration limit for non-listed substances under SR 817.023.21 Annex 6) has been confirmed in multiple converter surveys. If your ink supplier cannot provide a migration test result per EN 1186 or ISO 14855 simulant conditions, flag that formulation for reformulation or replacement.

For pad printing on plastics and silicones specifically — common in cosmetic and promotional item packaging — check whether the ink system is tested against ISO 2836:2021 (printing inks, resistance of prints). This standard covers rub, chemical, and heat resistance, and a passing result is a baseline quality qualifier, not a compliance certificate. These are different things and buyers sometimes conflate them.

Response time matters too. A supplier who can return a market-specific DoC within 48 hours has the documentation infrastructure in place. Suppliers who take two weeks to produce a DoC are typically generating it reactively, and the quality of the underlying data reflects that.

Cost-Performance Trade-offs: UV Cure vs Solvent-Based vs Water-Based #

The compliance cost difference between UV-cured and solvent-based screen ink systems is not primarily in the ink price. The cost driver is documentation, reformulation risk, and testing frequency.

Compliance testing cost ranges based on third-party lab quotes from SGS, Intertek, and Bureau Veritas for single-market DoC generation as of early 2024. Multi-market bundled testing reduces per-market cost by roughly 30–40%.

The counterargument for solvent-based systems: on absorbent or textured substrates where UV cure adhesion is unreliable, solvent-based pad ink is technically correct and UV curing is not a viable alternative. Forcing UV ink onto a substrate it doesn’t bond to creates delamination in field — which is a worse consumer safety outcome than a well-managed solvent system with proper VOC controls. We’ve run solvent-based pad ink jobs on soft-touch coated rigid boxes where UV systems consistently failed adhesion cross-hatch (ISO 2409) at the 0/1 boundary. For those jobs, solvent system with a compliant formulation was the right answer.

Regulatory Deep-Dive: Market-Specific Compliance Documentation Requirements #

This is where packaging jobs stall at customs or fail retailer vendor audits. The documentation requirements across the EU, US, and Chinese domestic markets differ enough that a single compliance package rarely covers all three.

EU market: Requires a Declaration of Compliance referencing REACH (EC) 1907/2006 for SVHCs, EN 71-3 for toy-adjacent packaging, and SR 817.023.21 for food-adjacent printed packaging. An SVHC Communication Letter per Article 33 must accompany shipments where any SVHC exceeds 0.1% w/w. RoHS 2 (Directive 2011/65/EU) applies where the packaging contains electronic or electrical function (battery-included gift packaging, for example). PPWR (EU Packaging and Packaging Waste Regulation, currently in final legislative stage as of Q2 2025) will impose recycled content and recyclability requirements that affect ink and coating choices — specifically fluorescent and metallic ink systems that interfere with paper recycling streams.

US market: No single federal ink-on-packaging standard equivalent to EU REACH exists. Compliance is driven by a combination of FDA 21 CFR (for food-adjacent), California Prop 65 (for lead, cadmium, and certain aromatic amines in inks), and retailer-specific requirements. ASTM F963 (Standard Consumer Safety Specification for Toy Safety) covers toy packaging and references heavy metal migration limits consistent with EN 71-3 numerically but uses different test protocols — so a product that passes EN 71-3 Category III does not automatically pass ASTM F963 without separate validation. This is a documentation gap we see regularly in briefs from clients who assume EU certification covers the US automatically.

China domestic market: GB/T 27630-2011 governs VOC content in interior coatings and has been referenced in some domestic compliance frameworks for printed packaging, though direct applicability to screen and pad inks on packaging depends on end use classification. GB 4806.1-2016 and the associated food contact materials series (GB 4806.x) set migration limits for food contact packaging. For export packaging produced in China, GB standards are typically not required by overseas regulators, but domestic factory audits (e.g., SMETA, ISO 22000) may reference them.

One area where practice varies significantly across converters: how often ink formulations are requalified after supplier reformulation. Some production operations requalify only when a supplier flags a change. Others run annual requalification regardless. Our practice is annual third-party confirmation for food-adjacent and toy-adjacent ink batches, and requalification triggered immediately whenever a supplier issues a revised SDS — not just when they explicitly flag a formulation change, because SDS revisions sometimes reflect compositional shifts that weren’t disclosed in supplier change notifications. Our dataset on this covers 47 ink lots across 12 suppliers over a 3-year period; we identified 3 cases where SDS revision preceded a compliance-relevant formulation change that was not separately notified.

A limitation worth naming: our compliance tracking focuses on EU and US markets because that’s where roughly 80% of our export volume ships. Our documentation framework for ASEAN market-specific requirements — particularly Indonesia SNI standards and Vietnam QCVN food contact regulations — is less systematized, and we rely more heavily on third-party lab interpretation for those markets.

Specification Notes for Brand Partners #

When you brief us on a screen or pad printing job that will carry a compliance requirement, the single most useful thing you can send upfront is the destination market list and the end-use category (food-adjacent, toy, cosmetic, general retail). Those two variables determine the ink system shortlist before we discuss anything else.

The brief gap that causes the most sample iterations: clients specify a Pantone color without flagging that the substrate has a food-adjacent function. We match the color, run the first sample, then find out the ink system we used isn’t cleared for SR 817.023.21. Reformulating to a compliant pigment set often shifts the color delta (ΔE) by 1.5–3.0 units, which requires reapproval. Flagging the compliance requirement at brief stage means we select a compliant ink system first, then optimize the color match within that constrained palette.

Our standard sampling timeline for screen or pad printing jobs with compliance documentation is 18–22 working days from approved ink specification to color-confirmed physical sample. Jobs requiring new third-party migration testing add 10–15 working days depending on the test lab’s current queue. If you have a hard launch date, share it at brief stage — we can often sequence lab testing in parallel with sample production rather than after it.

What ink test data should I request before approving a screen printing ink for EU food-adjacent packaging?

Request a Declaration of Compliance citing REACH (EC) No 1907/2006 SVHC status, a migration test report per EN 1186 or equivalent simulant conditions against SR 817.023.21 Annex 6 limits, and a photoinitiator-specific migration result if the ink is UV-cured. An SDS alone does not satisfy EU food-adjacent documentation requirements.

Does passing EN 71-3 toy testing in Europe automatically cover US toy packaging compliance?

No. ASTM F963 uses different test protocols from EN 71-3, even where the heavy metal migration limits are numerically similar. A product validated under EN 71-3 Category III needs separate ASTM F963 testing for US market documentation — the same test data cannot be directly referenced for both markets.

If I’m shipping printed packaging to both the EU and the US, can I use one compliance package?

It depends on the end-use category. For general retail packaging, a REACH DoC plus FDA 21 CFR compliance letter usually covers the core requirements. For food-adjacent or toy packaging, the test protocols diverge enough that separate EU and US documentation is needed. Bundling the testing with one lab typically reduces the combined cost by 30–40% versus commissioning them separately.

How does PPWR affect ink choices for screen-printed packaging entering the EU?

PPWR targets packaging recyclability, and certain fluorescent, metallic, and UV-reactive ink systems can interfere with paper and board recycling stream contamination thresholds. The specific ink restrictions under PPWR implementing acts are still being finalized as of Q2 2025, but the direction is clear enough that we’re already advising clients on EU-destined print jobs to avoid ink systems flagged under the Cepi/DS Smith recyclability assessment frameworks.

Our pad printing supplier says their ink is “RoHS compliant” — is that sufficient for EU toy packaging?

RoHS 2 (Directive 2011/65/EU) covers hazardous substances in electrical and electronic equipment — it is not a toy safety standard. EN 71-3 is the applicable standard for toy packaging, and heavy metal migration limits under EN 71-3 Category III are set differently from RoHS substance thresholds. RoHS compliance on a pad ink is a useful data point but does not substitute for EN 71-3 testing on toy-adjacent packaging.
