TL;DR: Compliance documentation failures — not print or structural defects — are the most common reason colour cosmetics packaging shipments are held at US and EU customs, and they are entirely preventable at the brief stage.

Why Colour Cosmetics Packaging Fails Regulatory Review (and Where Each Market Diverges) #

The compliance picture for makeup packaging is more fragmented than most brand partners expect. A lipstick outer carton that clears FDA review without issue can still be rejected by EU customs if the ink system contains restricted substances under REACH Regulation (EC) No 1907/2006 — specifically Annex XVII restrictions on azo colorants or phthalate plasticisers in surface contact applications. The carton itself hasn’t changed. The regulatory lens has.

Before any structural or print work begins on a colour cosmetics brief, our packaging applications team runs what we call a Market Entry Matrix check — a structured cross-reference of the target market’s packaging-specific regulations against the proposed substrate, ink, adhesive, and finish stack. This takes roughly 2 working days for a standard folding carton and up to 5 days for a rigid box with multiple material layers.

The three markets our brand partners most frequently target — the US, EU, and China — each operate under distinct primary frameworks:

  • US: FDA 21 CFR Part 700–740 governs cosmetic labelling and colour additive use. The FDA Cosmetic Labeling Guide specifies required label elements including ingredient declaration under INCI nomenclature, net quantity, and responsible party information. Packaging inks and coatings are not directly regulated under cosmetic law but fall under general food/drug/cosmetic contact principles when inner surfaces contact product.
  • EU: Regulation (EC) No 1223/2009 on cosmetic products governs product safety and labelling. Packaging materials must not transfer restricted substances to the cosmetic product. REACH SVHC threshold for reporting is 0.1% w/w per Article 33. The EU Packaging and Packaging Waste Regulation (PPWR), which entered force in 2024, adds recyclability and recycled content targets that now affect structural material choices.
  • China: GB 5296.3-2008 governs cosmetics labelling for domestic market sales. Import cosmetics must also comply with National Medical Products Administration (NMPA) registration requirements, which include packaging material safety declarations. Our internal reference for this is logged as our CN-REG-03 submission checklist.

The Root Cause Most Teams Misdiagnose: Ink and Coating Chemistry, Not Substrate Grade #

When a regulatory query comes back on colour cosmetics packaging, the instinct is usually to look at the substrate — whether it’s FSC-certified, whether the board weight is correct, whether the greyboard meets GB/T 22819 thickness tolerances. Those are rarely the problem.

The actual failure point, in the majority of cases we encounter during pre-production compliance review, sits in the ink and coating stack. Specifically: UV-curable offset inks contain photoinitiators — compounds that enable the rapid crosslinking reaction under UV exposure — and several of these, including ITX (isopropylthioxanthone) and benzophenone, are flagged under EU REACH and are subject to migration limits when the packaging has any possibility of indirect contact with the cosmetic product.

For a standard folding carton with a full UV gloss coating on the outer surface only, migration through the board is the concern. Uncoated reverse surfaces accelerate this. The EuPIA (European Printing Ink Association) Guideline on Printing Inks Applied to the Non-Food Contact Surface of Food Packaging Materials — which EU regulators also reference for cosmetic packaging ink safety — sets a migration limit of 10 ppb for non-intentionally added substances (NIAS). Our standard specification for any EU-market cosmetics carton uses low-migration (LM) ink systems with photoinitiator profiles verified against this threshold. Switching to LM inks adds roughly 8–12% to ink cost on a typical 4-colour job, but it eliminates a compliance risk that could otherwise hold an entire shipment.

The measurement method matters here. Migration testing per EN 1186 series (specifically the simulant-based extraction methods) is the EU-accepted approach. We request migration test certificates from our ink suppliers at minimum once per 12 months, or after any formulation change — not just at the start of a new supplier relationship.

One nuance worth flagging: matte water-based coatings, increasingly specified for the premium tactile finish popular in colour cosmetics, have a very different photoinitiator risk profile than UV systems. The risk there shifts to biocide content (isothiazolinones used as preservatives in water-based coatings are regulated under EU Biocidal Products Regulation 528/2012). The compliance check is different, not absent.

Corrective Actions When a Compliance Gap Is Identified Pre-Production #

  1. Switch ink system before plates are made. If a LM ink gap is identified during pre-production review, this is the lowest-cost correction point. Ink changes before plate-making add zero tooling cost and typically 3–5 working days for re-verification. After plates are approved and production has started, the cost and delay multiply significantly.

  2. Obtain a full substance declaration from the coating supplier. Our standard requirement is a declaration aligned with ISO 22000 food safety management principles, even though cosmetics packaging is not food packaging — because this framework produces the substance-level transparency needed for REACH SVHC checks. A generic “RoHS compliant” certificate is not sufficient and does not address SVHC at 0.1% w/w.

  3. Redesign substrate layering if inner surface contact is present. Where a carton’s inner surface contacts loose powder or direct-fill cosmetic product (common in pressed powder compacts and palette trays), barrier coating or a food-grade PE liner interleaf is specified. This adds 15–20% to unit cost for the liner option but removes migration risk entirely.

  4. Commission third-party migration testing before shipment. For EU market entry on any new packaging specification, we recommend one-time third-party migration testing per EN 1186 before the first production run ships. Cost is typically in the range of USD 300–600 per test, depending on the number of simulants tested. This is a one-time qualification cost, not per-shipment.

  5. Update the CPNP notification if packaging changes post-launch. EU brands sometimes overlook this: a material change to the packaging (new ink system, new coating, new substrate supplier) that affects the safety profile requires updating the Cosmetic Product Notification Portal (CPNP) submission. Failure to update is a compliance gap under EC 1223/2009 Article 13.

What to Specify Upfront to Prevent Compliance Rework #

The most effective prevention is front-loading the regulatory brief. When we receive a packaging enquiry for colour cosmetics, the specification checklist we run before quoting includes: target market(s), inner surface contact classification (direct, indirect, or none), UV versus water-based finish preference, and whether the brand has an existing Responsible Person arrangement for EU market. These four data points determine the ink and coating system before any structural work begins.

For the PO and spec sheet, brands should request from their packaging supplier: a full substance declaration for ink and coating systems, an FSC chain-of-custody certificate if recyclability claims are made, and — for EU market — a written confirmation that photoinitiator profiles comply with EuPIA guidelines. Request these as named documents, not general compliance statements.

Specification Notes for Brand Partners #

When you brief us on colour cosmetics packaging with a compliance angle, the single most useful piece of information you can provide upfront is the target market and whether the packaging has any inner surface contact with the cosmetic product. These two inputs govern the entire ink and coating specification.

A gap we see repeatedly in initial briefs: brands specify a finish (matte, gloss, soft-touch) without specifying whether it’s UV or water-based. For EU market compliance, this distinction changes the regulatory pathway completely. If you’re unsure, tell us the tactile result you want and we’ll specify the chemistry.

Our standard pre-production compliance review takes 2–5 working days depending on material complexity. Sampling for a new folding carton specification runs 15–20 working days from approved artwork and confirmed material spec. Rigid box sampling with novel coatings runs 20–28 working days. Frequently Asked Questions

Does FSC certification on the board mean the packaging is EU-compliant for cosmetics?
No. FSC addresses fibre sourcing and chain of custody, not chemical safety or migration. A board can be FSC-certified and still contain a coating with restricted biocides. EU compliance for cosmetics packaging requires REACH SVHC review and, where applicable, migration testing per EN 1186 — separate processes from FSC certification entirely.

Our lipstick carton uses a foil hot-stamp finish. Does that need REACH review?
It does. Metallic foils used in hot-stamping contain aluminium, polyester, and release coat layers, and some release formulations use silicone or wax compounds that may contain SVHC candidates above the 0.1% w/w reporting threshold. We run a substance declaration check on all foil suppliers as part of our standard pre-production process for EU-market jobs.

We’re selling in the US only. Do we still need migration testing?
For US-only distribution with no inner surface contact between packaging and cosmetic product, migration testing is generally not required. FDA 21 CFR Part 700 series does not mandate it for secondary packaging. The calculus changes if your carton has an inner surface that touches loose powder, direct-fill product, or if you anticipate expanding to EU markets within 24 months — retroactively qualifying a packaging specification already in production is more disruptive than doing it once upfront.

Can we use the same packaging specification for both US and EU market?
Often yes, but the ink and coating system must be specified to the more stringent standard — which is typically the EU. A LM ink system with EuPIA-compliant photoinitiator profile will satisfy EU requirements and is not restricted under US FDA principles. The incremental cost of specifying to EU standard on a US-market job is the 8–12% ink cost premium noted earlier — a reasonable hedge if EU expansion is on the roadmap.

What’s the minimum order quantity for a compliance-reviewed cosmetics carton run?
Our MOQ for folding cartons with a full pre-production compliance review (substance declarations, LM ink verification, print proof approval) is 5,000 units per SKU. Below that threshold, the per-unit compliance documentation cost becomes disproportionate and we’d typically recommend consolidating SKUs into a single run. Rigid boxes with compliance review carry a 500-unit MOQ per SKU.
